COURT DISMISSES ALLEGATIONS AGAINST DEFENDANT, ORDERS COMPLAINANT TO PAY PENALTY; PAKISTANI NATIONAL SET FREE

The Court has dismissed all allegations against Mr. Fahad, finding that the evidence presented did not sufficiently establish the offences with which he had been charged.

After carefully considering the communications placed before the Court, together with the evidence and submissions presented by both the prosecution and the defendant, the Court delivered its findings and brought the proceedings against Mr. Fahad to an end.

According to the findings, the complainant had presented herself as a child experiencing domestic violence and approached Mr. Fahad seeking assistance. The Court found that Mr. Fahad declined to provide the assistance requested.

Following the refusal, the complainant directed racist and abusive remarks towards Mr. Fahad, to which he subsequently responded.

The Court acknowledged that the language used by Mr. Fahad was inappropriate and stated that such slang was not condoned. However, having considered the remarks within their broader context, the Court concluded that the language did not amount to, nor was it tantamount to, the offences with which Mr. Fahad had been charged.

The Court therefore found that the allegations had not been sufficiently established by the evidence before it. As a result, the allegations were dismissed and the proceedings against Mr. Fahad were formally brought to an end.

Court Expresses Regret Over Hardship

The Court also acknowledged the considerable hardship and distress Mr. Fahad had experienced throughout the proceedings.

In its decision, the Court expressed sincere regret for the difficulties he had endured during the legal process, recognising the impact that the proceedings had had on him.

Finding Regarding Complainant's Age

The Court further found that the complainant had concealed her true age. It considered this conduct to be a serious matter, particularly because her age was material to the circumstances that led to the proceedings.

In light of its findings, the Court ordered the complainant to pay a financial penalty of £2,460, with payment required on or before 30 July.

The Court stated that failure to pay the ordered amount within the prescribed period could result in additional financial consequences or enforcement measures, where permitted by law and as determined by the Court.
